Judge Oleg Melnychuk, who is involved in a number of criminal proceedings, will also be investigated for sexual harassment. On Tuesday, the Superior Council of Magistracy (SCM) allowed taking legal action against the judge at the request of interim prosecutor general Ion Munteanu, IPN reports.
Oleg Melnychuk attended the SCM’s meeting. The matter was examined in camera. Following deliberations, with eight votes in favor and two against, the SCM members decided to give their consent to the criminal investigation of the judge based on Article 173 of the Criminal Code – “sexual harassment”.
The acting prosecutor general asked for consent to start criminal proceedings for sexual harassment against judge Melnychuk as early as May 2022. Then, the SCM rejected the given request and the Chisinau Court of Appeals, by its decision of October 12, 2023, annulled the Council’s decision and ordered to reexamine the request.
According to the SCM, judge Oleg Melnychuk does not currently try cases and does not benefit from the salary of judge as he was suspended from office in 2022 in connection with the passing by the Anenii Noi Court of a judgment in another case, of illicit enrichment.
Oleg Melnychuk is the first judge who was indicted for illicit enrichment. In September 2021, he was sentenced by the Anenii Noi Court to seven years in a closed prison. The sentence is not final. The judge pleads not guilty.
