The economic agents that will submit appeals within the public procurement procedures will be obliged to pay a state tax. This will constitute 0.5% of the estimated value of the procedure, but will not exceed 50,000 lei. If the appeal is admitted, partially or entirely, the tax will be refunded. The law introducing this provision was published on Friday in the Official Gazette. The new regulations will enter into force in a month, IPN reports.
According to the initiators of the law, the large number of appeals in public procurement generates significant delays in the execution of contracts, thus affecting the efficiency of the use of public funds. Under the new provisions, economic agents will have three days from the filing of the appeal to pay the state tax. Otherwise, the appeal will be returned without being examined.
In 2024, 1,245 appeals were filed, by 11% more than in 2023. Of these, 59 were submitted late, 30 were considered non-compliant, 36 were declared of no interest and 76 were returned without examination as they did not fall within the competence of the National Agency for Dispute Settlement.
